TO THE MAXIMUM EXTENT PERMITTED BY LAW, DSL NORTHWEST, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, MANUFACTURERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

THIS LIMITATION INCLUDES DAMAGES ARISING FROM LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE, SYSTEM OUTAGES, SECURITY BREACHES, OR OTHER COMMERCIAL LOSSES, EVEN IF DSL NORTHWEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, DSL NORTHWEST’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

14. Indemnification

You agree to defend, indemnify, and hold harmless DSL Northwest and its affiliates, officers, directors, employees, agents, suppliers, and partners from and against any claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys’ fees arising out of or related to your use of the Site, your violation of these Terms, your violation of applicable law, or your infringement of any third-party rights.

15. Intellectual Property Complaints

If you believe that content appearing on the Site infringes your intellectual property rights, please provide written notice containing:

Any claim arising out of or relating to the Site or these Terms must be commenced within one (1) year after the cause of action arises. Any claim not brought within that period shall be permanently barred to the fullest extent permitted by law.

20. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms of Use, together with any applicable Privacy Policy and other legal notices published on the Site, constitute the entire agreement between you and DSL Northwest regarding use of the Site and supersede any prior understandings, communications, or agreements relating to the Site.
